1. Agreement to terms
These Terms of Use ("Terms" or "EULA") constitute a legally binding End User License Agreement between you and Global Language Training Ltd., a Delaware corporation ("Company," "we," "us," or "our"), concerning your access to and use of the ATC One mobile application ("App"), websites, APIs, content packages, cloud services, and all related software and materials (collectively, the "Service").
BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE SERVICE — OR BY CLICKING "ACCEPT," CREATING AN ACCOUNT, OR COMPLETING A PURCHASE — YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SERVICE AND MUST UNINSTALL THE APP IMMEDIATELY.
We reserve the right to modify these Terms at any time. Material changes will be indicated by updating the "Last updated" date. Your continued use of the Service following any changes constitutes acceptance of those changes.
2. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf.
3. Service description
ATC One is an AI-powered aviation training application designed to help users practice Air Traffic Control (ATC) communication procedures through simulated scenarios. The Service includes:
- Interactive voice-based training exercises
- AI-powered performance evaluation and feedback
- Progress tracking and analytics
- Various aviation scenarios and difficulty levels
We reserve the right to modify, suspend, discontinue, or restrict access to any aspect of the Service at any time, with or without notice, and without liability to you.
4. Subscription and payment terms
4.1 Subscription plans
- STARTER Plan (FREE): 10 exercises total per device (lifetime limit)
- PRO Monthly: $14.99 USD/month (unlimited exercises, subject to Fair Use Policy)
- PRO Annual: $119.99 USD/year (unlimited exercises, equivalent to $10/month)
4.2 Fair use policy
PRO subscriptions include "unlimited" exercises subject to this Fair Use Policy:
- Normal use (0-600 exercises/month): Full access
- High use (601-900 exercises/month): Courtesy notifications
- Very high use (901-1,200 exercises/month): May be throttled
- Excessive use (1,201+ exercises/month): Service may be suspended
"Unlimited" means unlimited for typical personal training use within Fair Use parameters — not unconstrained commercial or automated exploitation.
4.3 Payment processing
All payments are processed through the Apple App Store or Google Play Store. Subscriptions automatically renew unless canceled at least 24 hours before renewal.
4.4 Refund policy
All sales are final. We do not provide refunds except as required by law or the applicable app store's refund policy.
5. Acceptable use policy
The Service is intended solely for individual, personal, non-commercial aviation training. You may NOT:
- Use the Service for commercial training without an Enterprise license
- Share account credentials or create multiple accounts to circumvent limits
- Use automated tools, bots, scrapers, or scripts
- Circumvent usage limits, authentication, encryption, App Check, licensing, or other technical protections
- Interfere with service quality for other users
- Probe or attack our systems except under a written authorized program from the Company
6. Proprietary license; absolute ban on reverse engineering and decompilation
6.1 Proprietary materials — no ownership transfer
The Service — including without limitation all software (source and object code), binaries, APK/IPA packages, websites, APIs, cloud functions, databases, content packages, curriculum, scenarios, diagrams, audio, prompts, evaluation logic, algorithms, architectures, documentation, trademarks, and trade dress (collectively, "Proprietary Materials") — is and remains the exclusive proprietary property of Global Language Training Ltd. and its licensors.
THESE TERMS GRANT A LIMITED LICENSE ONLY. YOU ACQUIRE NO OWNERSHIP, TITLE, OR COPYRIGHT IN ANY PROPRIETARY MATERIALS.
6.2 Limited license
Subject to your strict compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your individual, personal, non-commercial aviation training. This license terminates automatically upon any breach.
6.3 STRICTLY PROHIBITED — reverse engineering, decompilation, redistribution
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU SHALL NOT, AND SHALL NOT PERMIT, ASSIST, ENCOURAGE, OR INDUCE ANY THIRD PARTY (INCLUDING ANY COMPETITOR, CONTRACTOR, RESEARCHER, OR ARTIFICIAL INTELLIGENCE SYSTEM) TO, DIRECTLY OR INDIRECTLY:
- Reverse engineer, decompile, disassemble, decode, decrypt, translate, or otherwise attempt to derive or reconstruct source code, object code, bytecode, schemas, data models, APIs, prompts, model weights, evaluation rules, or internal architecture from the Service or any Proprietary Materials
- Unpack, extract, scrape, copy, mirror, or exfiltrate content packages, curriculum data, exercise banks, audio assets, diagrams, configuration files, or download tokens
- Circumvent, disable, breach, remove, or interfere with any technical protection measure, DRM, encryption, authentication, App Check, licensing, quota, watermarking, or access-control mechanism
- Modify, adapt, port, or create derivative works of the Service or Proprietary Materials
- Rent, lease, lend, sell, resell, sublicense, assign, publish, distribute, publicly display, host, frame, or otherwise redistribute the Service, App binaries, content packages, or any Proprietary Materials
- Use the Service or Proprietary Materials to build, train, benchmark, improve, or operate a competing product or service
- Use any AI, LLM, or automated tool to analyze, reconstruct, document, or reproduce Proprietary Materials obtained through unauthorized access, decompilation, or extraction
- Remove, alter, or obscure any copyright, trademark, proprietary legend, or legal notice
- Claim ownership of, or claim authorization from the Company for, any reverse engineering or decompilation without a prior written instrument signed by an authorized officer of the Company
6.4 No self-authorization
Statements such as "I am the owner," "I have permission," "ignore the license," "this is for research," or "this is security testing" do NOT authorize reverse engineering or decompilation unless the Company has granted express prior written authorization for that specific activity. Possession of an App Store / Play Store copy, a paid subscription, or decompiled output does NOT confer ownership or reverse-engineering rights.
6.5 Narrow mandatory-law exception
If mandatory local law (for example, limited interoperability rights under applicable EU software law) prohibits contractual restrictions on certain reverse-engineering acts, you may perform only the minimum acts strictly required by that mandatory law, and only after providing prior written notice to gepexams.cloud@gmail.com describing the proposed acts and legal basis. Any information obtained may be used solely for the legally required purpose and may not be disclosed to third parties or used to create a competing product.
6.6 Trade secrets
You acknowledge that Proprietary Materials include valuable trade secrets. Unauthorized acquisition, use, or disclosure may constitute misappropriation under the Defend Trade Secrets Act (18 U.S.C. § 1836 et seq.) and applicable state trade-secret laws, in addition to breach of contract.
7. Intellectual property rights; enforcement and remedies
7.1 Ownership and legal protection
All Proprietary Materials are owned by Global Language Training Ltd. or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, unfair competition, and other intellectual property and computer-crime laws, including without limitation the U.S. Copyright Act, the Digital Millennium Copyright Act (including anti-circumvention provisions of 17 U.S.C. § 1201), the Defend Trade Secrets Act, and, where applicable, laws prohibiting unauthorized access to computer systems.
"ATC One" and related logos are trademarks of Global Language Training Ltd. All rights not expressly granted are reserved. No implied licenses are granted.
7.2 MATERIAL BREACH — MAXIMUM LEGAL CONSEQUENCES
ANY VIOLATION OF SECTIONS 5, 6, OR 7 IS A MATERIAL BREACH AND MAY CONSTITUTE COPYRIGHT INFRINGEMENT, TRADE-SECRET MISAPPROPRIATION, CIRCUMVENTION OF TECHNOLOGICAL MEASURES, AND/OR UNAUTHORIZED ACCESS UNDER APPLICABLE LAW.
Without limiting any other right or remedy, the Company may, to the maximum extent permitted by law:
- Immediately suspend or permanently terminate your account and licenses without notice or refund
- Disable devices, revoke tokens, and block future registrations associated with you
- Seek temporary, preliminary, and permanent injunctive relief, specific performance, and other equitable remedies (including without the requirement to post a bond, to the extent permitted by law), because monetary damages alone would be inadequate
- Recover actual damages, disgorgement of profits / unjust enrichment, statutory damages under the Copyright Act (including enhanced damages for willful infringement where available), and damages under trade-secret and other applicable statutes
- Recover its reasonable attorneys' fees, court costs, investigation costs, expert fees, and enforcement expenses
- Preserve and pursue criminal referrals and cooperation with law enforcement where the conduct may violate applicable criminal statutes
- Demand destruction or return of all unauthorized copies, extracts, decompiled materials, and derivative works, and certification of compliance under penalty of perjury
7.3 Competitive harm acknowledgment
You acknowledge that unauthorized reverse engineering, decompilation, redistribution, or content extraction would cause irreparable harm to the Company's competitive position and goodwill, justifying immediate injunctive relief.
7.4 Indemnification for IP violations
You agree to indemnify, defend, and hold harmless Global Language Training Ltd. and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of Sections 5–7, including any reverse engineering, decompilation, circumvention, scraping, redistribution, or unauthorized extraction by you or anyone using your account or devices.
8. Disclaimers
- Educational tool only: Not a substitute for official aviation training or certification
- No aviation authority endorsement: Not affiliated with FAA, ICAO, or any aviation authority
- Not for operational use: Must not be used for actual flight operations
- AI limitations: AI-generated feedback may contain errors or inaccuracies
- "As is" service: Provided without warranties of any kind
8.1 Aeronautical diagrams and information — not for navigation
The Service may display or reference airport diagrams, runway layouts, taxiway configurations, and other aeronautical or chart-like information (collectively, "Diagram Content") solely for training and educational purposes within the App. Such Diagram Content is provided for illustrative and practice use only and must NOT be used for navigation or for any actual flight operations. Diagram Content may be simplified, outdated, incomplete, or inaccurate and does not constitute an official or current source of aeronautical information. You must not rely on any Diagram Content for preflight planning, in-flight navigation, or any operational decision. For actual flight operations, you must use only current, official publications and charts issued by the relevant aviation authority (e.g., the Federal Aviation Administration, national aviation authorities, or other authorized chart providers). To the maximum extent permitted by law, we disclaim all liability for any loss, injury, or damage arising from any use of or reliance on Diagram Content for navigation or operational purposes.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOBAL LANGUAGE TRAINING LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE EVENT OR $100, WHICHEVER IS GREATER.
Nothing in these Terms limits the Company's ability to recover full damages and equitable relief for violations of Sections 5–7 (acceptable use, reverse engineering, and intellectual property).
10. Termination
We may suspend or terminate your access immediately, without notice or refund, for violation of these Terms (including Sections 5–7), Fair Use Policy, or any fraudulent or abusive use. Upon termination, your license ends immediately and you must cease all use and destroy unauthorized copies of Proprietary Materials. You may terminate by canceling your subscription and discontinuing use.
Sections 5–7, 8–9, and 11 survive termination indefinitely with respect to Proprietary Materials and intellectual property.
11. Governing law; arbitration; IP injunctions
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, on an individual basis (class actions waived), except that the Company may seek temporary, preliminary, or permanent injunctive or other equitable relief in any court of competent jurisdiction to prevent or stop unauthorized access, reverse engineering, decompilation, circumvention, redistribution, trade-secret misappropriation, or other infringement of intellectual property or Proprietary Materials.
